Asylum Announcement - $100 Initial Fee and Recurring Annual Fee

Please note that a $100 initial asylum application fee was recently mandated by the One Big Beautiful Bill Act (H.R. 1), which was signed into law by President Trump on July 4, 2025. This fee introduction is a historic change, as asylum applications in the U.S. were previously free of charge. The new fees are non-waivable and non-refundable.

Payment Due at the Time of Submission
When an applicant submits his/her asylum application (Form I-589), the filing fee is $100, and it is to be paid at the time of submission/filing.

Asylum Cases Already Submitted & Pending
Court: If it is a “defensive asylum case” or the case is pending in the Immigration Court, use the EOIR Payment Portal (https://epay.eoir.justice.gov/index) and make the payment.

  • Enter your A# and ensure all information is correct.

  • Under Filing Type, select:
    Court – I-589, Application for Asylum (Initial Fee)

  • Click Pay Now.

  • You may choose from debit, credit, or any other available payment options.

  • Once payment goes through, a money receipt will be generated immediately. Save it for your record.

USCIS: If your asylum case is pending with USCIS, current guidelines state that payment is only due for applicants who filed asylum after Oct 1, 2024, and has been pending longer than 365 days. The payment will be considered as Annual Asylum Fee (AFF).

Note: Applicants must pay the AAF as of the one-year anniversary of his or her filing date and each year thereafter that the application remains pending on such day of the calendar year. For the first time the AAF is due, USCIS will issue personal notices detailing how to pay, the amount of payment and the consequences of failure to pay. USCIS will provide guidance for future years’ AAF payments in subsequent issuances.
