Miranda Rights Don’t Apply to Warrant-Backed Immigration Arrests, Court Rules
On Friday, a three-judge panel for the 9th Circuit Appeals Court (California) unanimously decided to decline extending Miranda rights to non-citizens facing deportation if immigration authorities have a warrant for their arrest. The reasoning behind the decision is that because deportations are civil and not criminal proceedings, non-citizens are not entitled to Miranda warnings. The 9th Circuit is one of at least seven appeals courts to rule that Miranda does not apply to civil immigration proceedings. One judge noted that the issue should be revisited in the future, arguing that although he agrees Miranda does not apply to civil proceedings, there should be similar requirements for deportation cases.

Congress Punts on Supplemental Funding While Setting Up Future Fight on Immigration
Early last week Congress passed a continuing resolution bill to fund the government until the end of the year, as legislators continue to debate what to do with President Biden’s request for emergency funding to address the southern border. The debate is struggling to reach a resolution as Republicans continue to insist that any funding for Ukraine and their war effort come with serious changes to border policy, among a list of other demands. Namely, the Republican proposal/list of demands mirrors language from HR2 (“Secure the Border Act”) , passed in the House earlier this year, including ending humanitarian parole, ending humanitarian protections, increasing restrictions on asylum qualification, and a mass detention policy for anyone that enters the country illegally. As such, it is no surprise a compromise is struggling to be reached.
Biden Plans to Deploy Immigration Officers to Panama to Help Screen and Deport U.S.-Bound Migrants, Officials Say
Recently, two U.S. government officials told CBS news that the Biden administration is planning on deploying a team of U.S. immigration officials to Panama to help screen and deport migrants traveling through the country. The plan has not been implemented yet as it is waiting for the all the details to be ironed out in a final agreement with the Panamanian government, but it is expected to move forward as Panama requested the assistance. The objective is to have personnel from various Department of Homeland Security agencies, including the U.S. Customs and Immigration Services, train and assist the Panamanian authorities as they grapple with the intensified flow of migrants., screening those who qualify for humanitarian protection and deporting those that don’t. The initiative will be subsidized by the State Department, and the Biden administration has notified Congress of its plan to divert money from the Department of Homeland Security to fund the effort.

Mexico ‘Rejects’ Texas’ Proposal to Allow State Police to Deport Undocumented Immigrants
In response to the Texas Legislature passing SB4 (Senate Bill 4), a bill that makes it a state crime to enter Texas illegally and authorizes local authorities to deport those who don’t adhere, the Mexican government has stated it “categorically rejects” Texas’ proposal. A statement from Mexico’s Secretary of Foreign Relations said “The Government of Mexico reiterates its rejection of any measure that contemplates the involuntary return of migrants without respect for due process.” The statement added, “The Government of Mexico categorically rejects any measure that allows state or local authorities to detain and return nationals or foreigners to Mexican territory.” However, the statement did not explicitly mention that Mexico would absolutely refuse to accept migrants removed from Texas under SB4. Texas Governor Abbot is expected to sign the bill into law soon, stating on Twitter on Wednesday that he “looks forward to signing Senate Bill 4.”
Biden and López Obrador Talked Fentanyl and U.S.-Mexico Migration. They Pledged Solidarity
On Friday, President Biden and Mexican President Obrador pledged to work side-by-side to both manage the recent migration surge and confront illicit fentanyl-trafficking at the border. Biden’s and Obrador’s relationship in the past has been tense due to mutual criticism. As such, President Obrador’s presence at the Asia Pacific Economic Conference, where the talk took place, was a shock, especially considering his intentional absence at last year’s conference. President Biden stated, “Nothing is beyond our reach in my view if Mexico and the United States stand together and work together.”
Trump Receives Endorsement from Texas Gov. Abbot at Border as Both Republicans Outline Hardline Immigration Agenda
At a campaign event near the U.S.-Mexico border on Sunday, former President Trump received an endorsement from Texas Governor Abbot. This comes in the wake of both Trump’s recent escalation of hardline immigration rhetoric along the campaign trail and the Texas Legislature passing a soon-to-be-signed bill allowing Texas State police officers to arrest undocumented immigrants. Governor Abbot stated at the event "We need a president who's going to secure the border." The article elaborates on Trump’s and Abbot’s immigration policy records, past and recent.
