Know Your Rights with Immigration and Customs Enforcement (ICE)

In light of recent announcements regarding mass deportations and potential ICE raids in sensitive areas like schools, hospitals, and churches, we want to remind you that you do have legal rights. IF ICE IS AT YOUR DOOR:

  • You do not have to open the door just because ICE knocks. You can remain silent or ask for the warrant before engaging.

  • A Judicial Warrant is a document signed by a judge that specifies the time frame when the search can be conducted and what items or individuals can be searched for and taken.

  • It is important to note that ICE cannot enter non-public areas (e.g., your home or private spaces) without a judicial warrant, unless there are exigent circumstances (emergency situations like imminent danger).

IF ICE IS INSIDE YOUR HOME:

  • You can tell them you do not consent to their search and ask them to leave.

  • You can refuse consent to search unless they have a judicial warrant.

  • Stay calm and do not resist, as that may lead to further legal complications.

  • If ICE does not have a judicial warrant, they should leave once asked.

IF ICE STOPS YOU ON THE STREET OR IN PUBLIC:

  • You have the right to remain silent and ask if you are free to leave.

  •  If agents try to search your pockets and belongings, say you do not consent to a search.

  • If they are detaining you or questioning you, ask if you are under arrest. If you are not under arrest, you have the right to leave.

IF ICE COMES TO YOUR PLACE OF BUSINESS:

  •  ICE may enter public spaces of your business (e.g., lobby or supermarket) without a warrant. ICE cannot enter private spaces (e.g., offices, storage areas) without a warrant.

  • If ICE agents have a warrant, they may ask to inspect I-9 forms and search for undocumented workers

  • Businesses can face penalties for hiring undocumented workers, ensure you have I-9s for all your employees.

  • Business owners and employees do not have to speak with the ICE agents.

REMEMBER:

  • You have rights, and it’s important to stay calm and informed when interacting with ICE.

  • These executive orders are being challenged by attorney generals across several states. Continue to go to work, school, and their places of worship while keeping these rights in mind.
