ICE Warrant Checklist – Know Your Rights

✅ Step 1: Stay Calm & Ask to See the Warrant

• Do not let ICE into non-public areas until you review the warrant.

• Ask them to slide it under the door or show it through a window.

✅ Step 2: Check WHO Signed It

Signed by a judge (federal or magistrate judge) → This is a judicial warrant. ICE may have authority to enter.

Signed only by ICE or DHS officer → This is an administrative warrant. It does NOT give ICE the right to enter private areas without permission.

✅ Step 3: Check the DETAILS

Name(s): Does it list the exact name of the person ICE wants?

Address: Does it list your company’s correct address?
 
Scope: Does it say whether it’s for a search (place) or an arrest (person)?

Date: Is it current and valid?

✅ Step 4: Know the Limits

• ICE can only go where the warrant allows (specific address, person, or area).

• Administrative warrants (Form I-200, I-205) do not authorize entry into private spaces.

• You do not need to answer questions or provide records unless the warrant specifically requires it.

✅ Step 5: Protect Your Rights

• You can say: “I need to review the warrant before allowing access.”

• Do not sign anything without legal advice.

• Contact your attorney immediately.

🚨 Remember:

• Public areas (like a store open to customers) can be entered without a warrant.
• Private/non-public areas (like offices, back rooms, employee-only areas) require a judicial warrant or your consent.
